Welcome to Jannis Group LLC.
These Terms of Service ("Terms") govern your access to and use of our website, online store, products, content, features, tools and related services (collectively, the "Services").

Jannis Group LLC operates this online store using Shopify's ecommerce platform. When you purchase a product through our store, the contract of sale is between you and Jannis Group LLC, not Shopify.

SECTION 3 — ORDERS AND CONTRACT FORMATION
When you submit an order, you are making an offer to purchase the products in your order.
An automated order acknowledgement does not necessarily mean that we have accepted your order.
Unless otherwise stated during checkout, a contract between you and Jannis Group LLC is formed when we confirm that your order has been accepted or dispatched.
We may decline an order before acceptance for legitimate reasons, including:

Nothing in these Terms restricts any statutory cancellation, withdrawal, rejection or refund right available to you.
Unless we expressly agree otherwise, products sold through our consumer store are intended for personal or household use and not for commercial resale.
SECTION 4 — PRICES, TAXES AND PAYMENT
The price charged for a product will be the price presented to you during checkout when you place your order, subject to correction of obvious errors before a contract is formed.
Where required by applicable law, displayed prices and the final checkout price will include applicable taxes such as VAT, GST or sales tax.
Before you submit an order, we will display or otherwise disclose applicable charges that we are required to disclose, which may include:

If specific promotional terms conflict with these Terms in relation to that promotion, the specific promotional terms will apply, subject always to mandatory consumer law.
You agree to provide valid and accurate payment information and confirm that you are authorised to use the payment method submitted with your order.
We may use third-party payment processors to process transactions.
SECTION 5 — SHIPPING, DELIVERY AND RISK OF LOSS
Delivery dates and delivery windows displayed through the Services are estimates unless we expressly agree that a particular delivery date is guaranteed.
We will take reasonable steps to deliver orders within the estimated or agreed timeframe.
We are not responsible for delays caused solely by events outside our reasonable control, such as severe weather, natural disasters, major transportation disruptions, strikes, customs delays or governmental actions.
However, nothing in this section removes any statutory right you may have if goods are not delivered within an agreed or legally required period.
Where we arrange shipping, risk of loss or damage remains with us until the goods are delivered to you or to another person you have authorised to receive them, except where applicable law provides otherwise.
If you independently appoint a carrier that was not offered by us, different rules concerning risk may apply where permitted by law.
If an order is lost or materially damaged before risk has lawfully passed to you, please contact us so that we can provide the remedy required under applicable law.

This voluntary return benefit is provided in addition to your statutory consumer rights.

Statutory rights are not limited merely because our voluntary returns period has expired.

Products purchased from us are subject to any mandatory guarantees, warranties and consumer protections that apply in the country, state, province or territory where applicable law protects you.

Unless permitted by law or authorised by us in writing, you may not reproduce, distribute, publish, commercially exploit, modify or create derivative works from protected content belonging to us.
Nothing in these Terms transfers ownership of our intellectual property to you.
The Shopify name, trademarks and related intellectual property belong to Shopify or its applicable affiliates.
Other names, logos and trademarks appearing through the Services belong to their respective owners.
SECTION 9 — OPTIONAL AND THIRD-PARTY TOOLS
We may provide access to tools, applications, payment services, integrations or features operated by third parties.
Third-party services may be governed by separate terms and privacy policies.
Where we merely provide access to an independent third-party service, we do not control that service and cannot guarantee that it will always be available, uninterrupted or error-free.
Your use of an optional third-party service may therefore be subject to the third party's terms.
Nothing in this section excludes responsibility that applicable law places on Jannis Group LLC in connection with our own Services, our contractual obligations or third parties acting on our behalf.

SECTION 11 — RELATIONSHIP WITH SHOPIFY
Our online store is powered by Shopify.
Shopify provides technology that enables us to operate the store and offer the Services.
However, Jannis Group LLC is the seller or merchant of record for products purchased directly from our store.
The contract for the sale of our products is between you and Jannis Group LLC.
Shopify is not the seller of products offered by Jannis Group LLC merely because Shopify provides the ecommerce platform.
Nothing in this section affects any rights you may independently have against Shopify or another party where such rights exist under applicable law.
SECTION 12 — PRIVACY
Our collection, use and disclosure of personal information is described in our:

Because our store is hosted using Shopify, Shopify and other service providers may process certain personal information in connection with providing the ecommerce infrastructure, payment functionality and other Services.

SECTION 13 — REVIEWS, FEEDBACK AND USER CONTENT
You may be able to submit reviews, photographs, comments, suggestions, ideas or other content ("User Content").
You retain any ownership rights you have in your User Content.
By submitting User Content to us, you grant Jannis Group LLC a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, distribute and use that User Content for purposes reasonably connected with:

This licence applies only to the extent permitted by applicable law and subject to our Privacy Policy.

Existing orders, accrued rights and statutory consumer protections remain unaffected unless cancellation is permitted by applicable law.
Provisions that by their nature need to continue after termination, including provisions concerning intellectual property, liability, governing law and existing payment obligations, will continue to apply.
SECTION 17 — SERVICE AVAILABILITY
We aim to keep our website and online Services available and functioning properly.
However, we do not guarantee that the website will always be available without interruption.

SECTION 19 — LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, we do not exclude or limit liability to the extent that applicable law prohibits us from doing so in relation to matters such as:

Where permitted by law, we are responsible for loss or damage that is a reasonably foreseeable result of our breach of these Terms or our failure to exercise legally required care.
We are not responsible for loss that was not reasonably foreseeable and was not caused by our breach or legally actionable conduct.
If you purchase products as a consumer, we are generally not responsible for purely commercial losses such as loss of business profits, revenue, opportunity or business data resulting from use of products for commercial purposes, except where applicable law provides otherwise.
Any limitation in this section applies only to the extent permitted by applicable law.
SECTION 20 — YOUR RESPONSIBILITY FOR UNLAWFUL MISUSE
You are responsible for your own unlawful or deliberate misuse of the Services.
To the extent permitted by applicable law, you may be responsible for losses directly caused by your intentional violation of these Terms, infringement of another person's rights or unlawful use of the Services.
You are not required by these Terms to indemnify us for losses caused by our own breach, negligence, unlawful conduct or matters for which applicable consumer law makes us responsible.
SECTION 21 — EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be responsible for a delay or failure to perform an obligation where the delay or failure is caused by an event outside our reasonable control and where applicable law permits such relief.
Examples may include severe natural disasters, major infrastructure failures, war, governmental restrictions or significant transportation disruptions.
We will take reasonable steps to minimise the effects of such events.
Nothing in this section removes any right you may have to cancel an order or receive a refund where performance or delivery does not occur within a period required by applicable law.
SECTION 22 — SEVERABILITY
If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will apply only to the maximum extent legally permissible.
Where possible, the remaining provisions will continue in effect.
Nothing in this section permits us to replace an invalid consumer term with another term that would itself violate mandatory consumer law.
SECTION 23 — WAIVER AND ENTIRE AGREEMENT
If we do not immediately enforce a right under these Terms, that does not necessarily mean we have waived that right.
These Terms, together with policies expressly incorporated into them and the information forming part of your order, constitute the agreement between you and us regarding the relevant Services or purchase.

To the extent that a choice of law is legally permitted, these Terms and contracts with Jannis Group LLC are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.
However, this choice of law does not deprive you of any mandatory consumer protection available to you under the laws of your country, state, province or territory of habitual residence where those protections apply.
Nothing in these Terms requires a consumer to bring a claim exclusively in Wyoming if applicable consumer law gives that consumer the right to bring proceedings in another competent court, tribunal or dispute-resolution body.

Nothing in this section restricts any statutory right to seek assistance from a consumer authority, regulator, court, tribunal or dispute-resolution body.
SECTION 26 — COUNTRY-SPECIFIC CONSUMER PROTECTIONS
The following provisions clarify how these Terms interact with mandatory consumer protections in the markets in which we sell.
United States
Customers in the United States may have rights under federal and state consumer protection, product liability, warranty and other laws.
These Terms do not exclude any right or remedy that cannot legally be excluded under applicable federal or state law.
Any written product warranty or guarantee offered separately by us is subject to any mandatory requirements that apply to that warranty or guarantee.
United Kingdom
If you are a consumer in the United Kingdom, nothing in these Terms limits mandatory rights available under applicable UK consumer law.

Australia
For consumers in Australia, our goods and Services come with consumer guarantees that cannot be excluded where the Australian Consumer Law applies.
Nothing in these Terms is intended to exclude, restrict or modify rights or remedies under the Australian Consumer Law where doing so would be unlawful.
These rights exist independently of our voluntary 30-Day Return Guarantee.
Nothing in these Terms stating a time limit, warranty period or return period is intended to impose an unlawful limit on Australian consumer-guarantee rights.
New Zealand
For consumers in New Zealand, nothing in these Terms excludes, restricts or modifies rights under the Consumer Guarantees Act, Fair Trading Act, or other mandatory New Zealand consumer legislation where those laws apply.
Our voluntary guarantees and policies operate in addition to applicable statutory guarantees.
Terms in these Terms are not intended to permit us to engage in misleading conduct or rely on an unfair contractual term.
Canada
For consumers in Canada, consumer protection laws may differ between provinces and territories.
Nothing in these Terms excludes or restricts a mandatory right or remedy available under applicable federal, provincial or territorial law.
Where provincial or territorial law gives you protections concerning online contracts, disclosures, delivery, defective goods, cancellation, refunds or other consumer matters, those mandatory protections will continue to apply.
Switzerland
For consumers in Switzerland, nothing in these Terms is intended to restrict any mandatory consumer protection or non-excludable product-liability right.
Applicable Swiss rights relating to defective goods and legally protected warranty periods continue to apply notwithstanding our voluntary 30-Day Return Guarantee.

We may update these Terms from time to time to reflect:
